GENERAL DESCRIPTION OF OUR AUCTION

At Woodburn Auction Yard we conduct a consigned Machinery Auction three times a year. The first is at the end of January or first of February (we try to miss the Super Bowl). The second is mid-May and the third is the last week of September or the first week of October (we try to miss the opening of hunting season). The date for our next machinery sale will be set and announced at our current machinery sale. These auctions are a 2-day consigned Machinery Auction for miscellaneous tools and equipment, lawn and garden equipment and mowers, industrial machinery, tractors, crawlers, excavators, backhoes, forklifts, 4-wheelers, UTV’s, trucks, pickups, cars, trailers, campers, boats and farm machinery such as balers, swathers, hay rakes, combines, misc. farm implements and much more. Lunch is served on the grounds both days, so come by and enjoy.

AUCTION SCHEDULE AND ORDER

We start the first auction at 9:00 a.m. on Saturday in the Shed where we will sell miscellaneous tools and equipment. At 9:30 a.m. we start the second auction in the Arena where we will sell the lawn, garden and machine-tool type equipment.

When we are done selling those two categories we downsize to one Auction and start selling tractors, forklifts, trucks, pickups and cars by driving them through our Arena where, as a buyer, you will be seated in bleachers to bid.

After all of the rolling stock has been sold we will move out behind our Arena and sell tractor attachments, such as buckets, front end loaders, etc. We will then move on to the crawlers and excavators then to the titled trailers, campers and such. At this point we may start up a second Auction again and work the rows of miscellaneous equipment such as truck beds, fencing, pallet-racking and lumber until both Auctions have finished for the day.

Sunday we start at 9:00 a.m. in the Back Lot of our property. If you did not get a buyer number on Saturday, the office will also be out back of the property in a small white building. We will work the rows of farm machinery and implements such as post-hole augers, sickle bar mowers, tillers, box scrapers, livestock equipment and panels, balers, hay rakes, mowers/conditioners etc. and finish the day with the irrigation equipment.

HOW TO BUY

All buyers at our Machinery Sale will need to have a buyer number to bid, so please stop in at the office and register for a number; they will issue you a bid card which will be good for both days. If you would like to bid, please use this bid card to get the Auctioneer’s or Ring-Man’s attention. If you are the final bidder please hold the card high enough so that the Auctioneer can see your number. When he calls out your number please verify that it’s the right number–if for some reason we have the wrong number it is much easier to make changes at that point rather than later in the day.

If you have been issued a permanent number for our Tuesday Miscellaneous Auction or Woodburn Livestock Exchange’s Auction, that number will be good at any of our Auctions and you do not need to pre-register for a buyer number. Please do not ask for a permanent number–we have very few left and issuing them is not something we have time to deal with on a Sale Day. Thank you for your cooperation.

AFTER YOU BUY

When you are done purchasing for the day you will need to go to the office to check out and pay. Even if you plan on coming back for Sunday’s Auction, please pay for what you have purchased on Saturday. There is a 5% buyer’s premium charged on all purchases at our machinery sales. We accept cash, pre-approved check, Debit and Credit Cards. If you choose to use credit cards there will be an additional 4% surcharge added to your total to cover the amount the credit card company charges us.

If you have purchased a titled vehicle you will need to show proof of insurance before we can sell you a trip permit to drive it off the property. If you cannot show proof of insurance you will not be allowed to drive the vehicle off the property and will need to arrange to have it hauled, towed or leave it until you can show proof of insurance, at which time a trip permit will be sold to you.

For all other purchases, once you have paid for them you will be given a load-out slip and a WAY employee will help you with loading of your purchases and check your items off your load-out slip.

We ask that all purchases be removed within two weeks. If for some reason you cannot remove them within this time frame, give us a call and we can work out some type of plan with you for removal. Anything left longer than two weeks will be charged a storage fee. Anything left until the next Machinery Sale will be re-consigned, storage fees will be deducted from your check and the balance, if any, will be mailed to you.

LOAD-OUT HOURS

  • Monday 8:00 a.m. – 5:00 p.m.
  • No Tuesday load-outs (we are busy with our weekly sales)
  • Wednesday thru Friday 8:00 a.m. – 5:00 p.m.
  • Saturday (the week after the Machinery Sale) 9:00 a.m.-4:00 p.m.

CONSIGNING

We start accepting consignments for our next Machinery Sale on the Monday following our last one. However, most consignments tend to come in during the last couple of weeks before our sale. We recommend that you consign as early as possible so we can include your items in our advertisements—you will also have the exposure from the hundreds of people driving through on a weekly basis, either attending our Tuesday Auction or just stopping by to see what we have for the next Auction.

CONSIGNMENT HOURS

  • Monday 8:00 a.m. – 5:00 p.m.
  • No Tuesday consignments (please do not bring in consignments as we are busy with our weekly sales)
  • Wednesday thru Friday 8:00 a.m. – 5:00 p.m.
  • Saturday (the weekend before the Auction Only) 8:00 a.m. – 5:00 p.m.

COMMISSION

Commissions for our machinery sales are 25% on items bringing less than $250, and 10% on items above $250 with a $25 minimum commission per consignment.

Commission on titled vehicles is 10% with a $150.00 minimum per vehicle.

Storage fees may be charged at Woodburn Auction Yard’s discretion for items left over two weeks from the date of our last machinery sale. Storage fees will be charged at the rate of $25.00 per week, starting the third Monday after the Machinery Sale.

Household items and other misc. items that would normally be sold on our Tuesday Auctions

PROPERTY RULES

No smoking in any buildings or within 10 feet of entry doors.

No use of alcohol or drugs, this includes Marijuana. Even though the state of Oregon has legalized the use of Marijuana, Woodburn Auction Yard chooses to follow federal law and prohibit its use on our property.

No picture-taking of any kind, this includes cell phones and video cameras.

No dogs allowed on the property.

No children under the age of 13 allowed. If you do have children with you please keep them with you at all times, Auctions are hectic and crowded with quite a bit of traffic. We want to keep everyone safe.

TERMS AND CONDITIONS

A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them.

Though all description and commentary are believed to be correct, neither Auctioneer nor Seller makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, condition, etc.

ALL SALES ARE FINAL, AND ALL PROPERTY IS SOLD “AS IS, WHERE IS”. It is bidder’s responsibility to determine condition, etc. The Seller reserves the right to reject any and all bids it deems necessary.

The buyer shall be the highest bidder. In case of dispute between two bidders, the auctioneer may reopen the bidding between the highest bidders only, until property is sold.

When the Auctioneer says “SOLD”, title of the property shall pass to the highest bidder, who assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk and expense within the time period announced by the Auctioneer.

Auctioneer or Seller reserves the right to withdraw any item before or during the sale. Auctioneer may reject a nominal or fractional bid advance if, in his estimation, it proves injurious to the sale.

Neither Auctioneer nor Seller shall be liable for any personal injury on the sale premises. Buyer assumes all risk and liability whatsoever resulting from the use of the item (s) sold hereunder, and shall defend, indemnify and save blameless Seller and Auctioneer from any liability.

If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option may (1) resell the property publicly or privately, with purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining liquidated damages or payments made by purchaser. Auctioneer commission and all other incidental damages will be charged.

Buyer hereby agrees to assume the risk and to release and hold harmless all of the persons or entities mentioned who might otherwise be liable to it or it’s successors or assigns for damages.

Woodburn Auction Yard Inc. acts solely as an agent and is not party to any contract for the sale of any item sold at auction.
